Article 1 - General clause

These terms and conditions are applicable to any order. SARL ALGAN DE LUX reserves the right to change these terms and conditions at any time. Any customer having submitted an order is considered de facto to have accepted the current terms and conditions without restriction.

Article 2 - Registration requirements

Registration takes place in two stages :

- We check your registration details and send you necessary information to access your personal account.

Registration is reserved for professionals. Are considered among others as members of this community : architect, interior designer, home staging, retailer, florist, hotel, Bed and Breakfast, restaurant and bar, other...

- Password

Your password is not transferable and secret. You are responsable for it, and any use that may be made of it, even if it is used without your knowledge.

- Importante note

SARL ALGAN DE LUX reserved the right to refuse any customer access to prices.

Article 3 - Products presentation

SARL ALGAN DE LUX  cannot be held liable for any mistakes in the product descriptions. Photographs are not part in the contract.

Article 4 - Products prices

Our prices are stipulated in euros, net of VAT tax, ex-factory, packing included. Products will always correspond to those into force at the time of the order by our company.

SARL ALGAN DE LUX reserves the right to refuse to honor a customer's order if a previous order has not been fully or partially settled, or where there is dispute over payment.

Article 6 - Availability

Products and prices are valid while stocks last. In case of unavailability of a product after ordering,  SARL ALGAN DE LUX will inform you as soon as possible via email, fax, telephone or letter.

Article 7 - Shipping and delivery

Goods will be shipped to the delivery address specified during the ordering procedure. Delivery time includes the manufacture, the preparation and the delivery.

In the event of delivery non in conformity or prone to litigation, any reserve will have to be formulated precisely on receipt of the conveyor and will have to be followed within 48 hour as from the delivery by a register letter with acknowledgement of delivery addressed to the conveyor, copy being forwarded to SARL ALGAN DE LUX. Only the recipient exerts his recourse against the conveyor in the event of delays, lacks and/or damages.

Except contrary stipulation, it will fall to the purchaser to ensure the expenses and the risks of the transport of the sold goods, subsequently to the delivery.

Any delivery delays compared to the indicative times of delivery initially envisaged, will not give place to penalty or allowance, nor justify the cancellation of the order to SARL ALGAN DE LUX.

Shipping costs are due for each order. They are based on the number of itmes ordered, the weight and the geographical area of delivery.

Article 8 - Terms of payment

Except contrary stipulation, our invoices are payble in Saint-Brieuc (France) only by bank transfer on Pro-forma invoice, and without discount. All bank expenses remain at the client's charge.

In the absence of payment of one single invoice, all other invoices will becom full and immediately payable.

In addition, a fixed penality of 30 € Vat Excl will be applied to any payment subsequent to the third customer recovery.

Article 9 - Reserve of the right of ownership

SARL ALGAN DE LUX preserves the property of the goods sold until the effective payment of the full price in the main thing and accessory.

Non-payment of one of the terms will allow SARL ALGAN DE LUX to claim for the goods concerned.

Article 10 - Guarantees

The goods sold by SARL ALGAN DE LUX are guaranteed against all apparent defects and/or of operating coming from a defect of material, manufacture or design under the conditions below :

-  The apparent defect will have to be denounced to SARL ALGAN DE LUX at the time of the reception of the product,

-  The vice, one of possible operation will have to appear and to be immediately denounced to SARL ALGAN DE LUX within 30 days as from the delivery, for a use of the good in conformity with its destination and its nature.

SARL ALGAN DE LUX responsability is expressly limited to the guarantees and reserves above mentioned, and will not be looked after nor commited because of accidents and/or accidents caused to people or things in the event of abnormal installation and/or of use not in conformity with the destination or nature of our goods.

Dimensions of our designs are given only as an indication. SARL ALGAN DE LUX reserves the right to modify its designs at its discretion.

Article 11 - Sale abroad

The products we sell comply with electrical norm NF EN 60598-2-4 for the lamps.

However, SARL ALGAN DE LUX  may not be held liable if the products violate the legislation of a foreign country to which the products are delivered. It is the customer's responsability to check with local authorities on the possibility of importing or using the products ordered.

Article 12 - Responsability

The goods sold comply with the French legislation. SARL ALGAN DE LUX cannot be held diable for any events due to a case of force majeure, any disruption or fully or partially strike of postal services and transport and/or communication, flood, fire.

Article 13 -  Attribution of Jurisdiction

In the event of litigation of any nature the court of Saint-Brieuc will be qualified.

French law will apply.
